Thanks Salamander for the comment. See the proposed deal originally was this for the house. We get it appraised, we each get half. FINE. No prob.


Due to my short time being employed and low income status I cannot qualify for a loan at this time. I can make the payments, always have. Im the financial mastermind and always have been during the marriage. So as far as me going delinquent. Heck I could work McDonalds and still pay my house payment. And my ex knows very well how I am with money. I am the reason we were able to buy the house and how he is driving his new truck today. Within the year apart he his trashed his credit, and run up more debt then we had together. I in turn used my tax refund to pay off this JOINT community Debt. I have paid off 3 Loans ALL BY MYSELF, ::Patting self on back:: With no thanks to him.


Now yes I do have to factor in other expenses. Basically the only additions are water and trash that are extras for me. I have the low income program for all of my utilities which helps a lot. My vehicle is paid for. And I have my parents assistance with home repairs. They know that the house is important for me and will make sure I am taken care of.


Now if my ex had been decent about things like paying child/spousal support, have of community debts, childcare, etc. Then the option would be he would get his half of the equity when I am able to refinance the house in my name, OR, when I sell it.


How on earth does he expect a mother of 2 who makes just under $1000 a month and doesnt get her support to pay him $12,000 and pay HALF the value of the home furnishings? Its utterly ridiculous! Make sense folks?


So yes in writing he is entitled to half of the equity, but as my attorney says “Victoria, with all that he owes you, that you raise the children, etc, he wont get anything in the end, it will be negotiated back in what he owes you”
